Many Florida negligence lawsuits are subject to a two-year limitations period. The applicable deadline depends on when the claim accrued, the claim type, the defendant, and any applicable exception or notice requirement. Do not assume every injury claim has the same deadline. For negligence actions governed by Florida's comparative-fault statute, damages are generally reduced in proportion to the claimant's own fault. A claimant found more than 50% at fault for their own harm may not recover under subsection (6). The statute has exceptions, and not all claims are governed by the same rules.
