Important Florida Filing Point

Florida generally does not impose a single two-year deadline to open probate. The two-year period commonly discussed in probate is an outside limitation on many creditor claims—not a universal deadline for filing the probate petition.

The custodian of the original will must deposit it with the clerk having venue within 10 days after learning of the testator’s death. Families should still begin promptly when assets require protection, bills must be addressed, or property must be sold.
